These Terms of Service ("Terms") govern your use of the Kalanikama school management platform ("Service") operated by Kalanikama ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
Kalanikama is a multi-tenant, cloud-based school management platform designed for educational institutions. The Service provides tools for:

To use Kalanikama, an authorized representative of a school or educational institution ("School") must create an account. By registering, you represent that:
The School administrator creates and manages user accounts for staff, students, and parents. Each user receives credentials to access the platform according to their assigned role (administrator, principal, teacher, student, or parent).
You are responsible for maintaining the confidentiality of your login credentials. You must notify your School administrator immediately if you suspect unauthorized access to your account. School administrators must notify us at support@kalanikama.com for any suspected security breach.
You agree to use the Service only for lawful educational purposes. You must not:

Access to Kalanikama requires an active subscription. Subscription plans, features, and pricing are described on our website and may be updated from time to time. We will provide at least 30 days notice before any price increase takes effect on your account.
All payments are processed through Stripe in Euros (EUR). By subscribing, you agree to Stripe's terms of service. You authorize us to charge your selected payment method for the subscription fees on a recurring basis according to your chosen billing cycle.
We may offer a free trial period. At the end of the trial, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your access will be restricted but your data will be retained for 30 days.
Subscription fees are non-refundable, except where required by applicable law. If you cancel your subscription, you will continue to have access until the end of your current billing period.
Schools retain full ownership of all data they enter into the platform ("School Data"), including student records, attendance data, grades, financial records, and all other educational information. Kalanikama does not claim any ownership rights over School Data.
Kalanikama acts as a data processor on behalf of Schools. We process School Data solely to provide and improve the Service, as described in our Privacy Policy.
School administrators may export their School Data at any time through the platform's built-in export functionality. Data is provided in standard, machine-readable formats.
Upon termination of a School's account, we will retain School Data for 30 calendar days to allow for recovery. After this period, all School Data will be permanently deleted. Schools may request earlier deletion by contacting support@kalanikama.com.
The Service, including its design, code, features, documentation, and branding, is owned by Kalanikama and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
If you provide suggestions, ideas, or feedback about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback to improve the Service without any obligation to you.
We strive to maintain high availability of the Service. However, at this stage, we do not guarantee a specific uptime percentage or offer a Service Level Agreement (SLA). The Service may be temporarily unavailable due to:
We may modify, update, or discontinue features of the Service at any time. For significant changes that affect your use of the Service, we will provide reasonable advance notice.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Kalanikama shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Service.
Our total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless Kalanikama, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:
You may cancel your subscription and terminate your account at any time through the platform settings or by contacting support@kalanikama.com. Your access will continue until the end of your current billing period.
We may suspend or terminate your access to the Service immediately if:
Upon termination, your right to use the Service ceases immediately. We will retain your School Data for 30 calendar days, after which it will be permanently deleted. You may request a data export during this retention period.
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Paris, France.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kalanikama regarding the Service.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
We may modify these Terms at any time. We will notify School administrators of material changes by email at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the modified Terms.
